Die Linke proposes nationwide rent cap in Germany

The Die Linke parliamentary group has submitted a proposal to the Bundestag for a nationwide rent cap to combat housing shortages and unaffordable rents. The legislative draft includes three primary components: an immediate nationwide freeze on rents to stop short-term increases, the implementation of local rent ceilings that landlords cannot exceed during new leases or rent hikes, and a mechanism to lower rents that are already considered excessive.

To address constitutional concerns, the proposal includes a legal opinion by Thorsten Klingreen, which asserts that the regulations are compatible with the Basic Law. The proposal seeks to reform the calculation of local comparative rents by using true average rents rather than focusing on expensive contracts from the last six years.

Federal Minister for Housing Verena Hubertz (SPD) has criticized the proposal, labeling it unrealistic and difficult to manage in practice. Hubertz argued that such measures require sufficient political majorities to be effective and suggested that the focus should instead be on increasing housing supply to ensure affordability.
