Department of Justice declines appeal of NFA ruling in Texas
The U.S. Department of Justice has declined to appeal a federal court ruling that invalidates certain National Firearms Act (NFA) regulations. The decision, issued by U.S. District Judge James Wesley Hendrix in Texas, strikes down the mandated permitting and registration processes for items such as suppressors and short-barreled rifles and shotguns.
While the ruling is not universal and applies specifically to the named plaintiffs in the Jensen and Silencer Shop cases, a coalition of Republican lawmakers, including Representative Andrew Clyde, has urged the DOJ to use rulemaking to apply the decision nationwide. The DOJ stated it is currently assessing the impact of the ruling and respects Second Amendment rights.
Gun rights organizations and several commercial plaintiffs, including Silencer Shop, celebrated the decision. The ruling follows a law signed by President Trump that removed the $200 tax previously required for these permits.
