Machine guns and destructive devices remain subject to existing regulations.

On August 12, 2026, the U.S. Department of Justice declined to appeal the ruling. By failing to request a stay before the midnight deadline, the Trump administration allowed the decision to take effect for the named plaintiffs, which now includes the Firearms Regulatory Accountability Coalition, Hot Shots Custom LLC, and Palmetto State Armory LLC. The Justice Department issued an unsigned statement noting it “respects Americans’ Second Amendment rights and is currently assessing the impact of the court’s ruling.” While gun rights advocates have celebrated the decision, opponents argue it deregulates dangerous and easily concealable firearms.
