U.S. District Judge James Wesley of the Northern District of Texas ruled that certain registration and approval requirements of the 1934 National Firearms Act (NFA) are unconstitutional. Following the ruling, the U.S. Department of Justice declined to request a stay before the midnight deadline, allowing the decision to take effect for named plaintiffs, including the Gun Owners of America, the Silencer Shop Foundation, the Second Amendment Foundation, and 15 Republican-led states. Shortly after midnight on August 13, 2026, Brandon Herrera and Texas State Representative Wes Virdell completed the first unregistered suppressor transfers in Leander, Texas, since 1934. As of September 3, 2026, the National Shooting Sports Foundation (NSSF) reported a significant surge in NFA item transfers. Transfers of suppressors and short-barreled rifles tripled compared to the previous year, rising from 61,594 in August 2025 to 185,744 in August 2026. Gun Owners of America (GOA) Federal Affairs Director Aidan Johnston stated that the shift followed a six-month period of “top secret” behind-the-scenes lobbying designed to prevent opposition from reacting to legislative plans.
