Dominican Republic health sector to face criminal liability under new Penal Code

The Fundación Global Democracia y Desarrollo (Funglode) hosted the launch of the "Plan de Cumplimiento Penal para el Sector Salud" on the night of 30 July in Santo Domingo, marking its 25th anniversary. The plan, authored by lawyer Gilberto Objío Subero, MA and PhD(c) in Applied Artificial Intelligence, is aimed at health service providers, insurers and diagnostic centres to align their internal structures with the newly‑introduced corporate criminal liability regime.

Three days earlier, on 27 July, the Dominican Executive Power promulgated Law No. 74‑25, amending the Penal Code and rewriting article 8 to require prevention programmes to meet eleven minimum elements, up from four. The reform makes health a protected legal good, allowing criminal sanctions—ranging from six months to ten years’ imprisonment—for negligent or imprudent conduct by private clinics and health centres. The new code takes effect on 3 August. At the Funglode event, Dr Severo Antonio Mercedes Acosta presented the book’s prologue and Dr Héctor Eusebio, director of Funglode’s Center for Health Studies, highlighted the compliance components such as risk identification, an autonomous supervisory body, whistle‑blower channels and operational protocols.
