Dominican Republic Penal Code final amendment rush
Overview
The Dominican Republic’s new Penal Code (Law 74‑25), slated to take effect on 3 August 2026, is now in a fast‑track amendment sprint. A bicameral commission chaired by Deputy Wandy Batista has already examined more than 20 proposals affecting roughly 18 articles, many of which were highlighted by President Luis Abinader’s executive team. The Chamber of Deputies, under President Alfredo Pacheco, is set to approve the revised text between Thursday and Friday, with the Senate voting the following week. Key debates focus on defamation, injuria and ultraje clauses, the removal of the term “bullying” in favor of “hostigamiento” limited to educational settings, and new provisions on abortion, corporate liability and medical negligence. Professional bodies—including the Dominican College of Attorneys (CARD), the Foundation for Institutional Justice (Finjus) and the Alliance Dominican Against Corruption—have submitted amendments urging proportional penalties and stronger safeguards for journalists. President Luis Abinader and Justice Minister Antoliano Peralta continue to champion the code as a historic justice reform, while some legislators, such as Senator Guillermo Lama, argue for enacting the code first and tweaking it later. Public protests and cacerolazos have underscored concerns over potential censorship as the deadline approaches. In the weeks leading up to the launch, the Senate confirmed that changes to Article 141 will not affect the statute of limitations for sexual offenses against minors. The executive draft removed “bullying” from the labour context, restricting the new “hostigamiento” offense to educational and recreational settings. CARD submitted a package calling for the removal of privileged immunity for public officials in defamation cases, a reduction of maximum penalties, and a six‑month extension of the code’s entry‑into‑force date. Similar proposals were filed by the Fundación Primero Justicia and the Colegio Dominicano de Periodistas just hours before the deadline.
