Poland Pegasus scandal: Tusk calls data transfer to Israel a crime

Polish Prime Minister Donald Tusk has characterized the use of Pegasus spyware as a ‘serious crime against the state,’ describing it as one of the largest scandals in Poland since the fall of communism. The controversy centers on the transfer of sensitive data belonging to Polish citizens, opposition leaders, and independent prosecutors to Israel via the system developed by the Israel-based NSO Group.

An investigative commission has concluded its work with a 700-page report, resulting in criminal notifications against 11 individuals, including former Justice Minister Zbigniew Ziobro and former Interior Minister Mariusz Kamiński. Findings from the Polish Internal Security Agency (ABW) indicate that the Pegasus system could extract extensive data from mobile devices without user consent.

Furthermore, experts from the National Prosecutor's Office and the ABW determined that the Central Anticorruption Bureau (CBA) lacked full control over the system. This lack of oversight allowed the software developer to access the infrastructure where data was processed and enabled the transfer of sensitive information outside of Polish territory to foreign servers.
