Osman Kavala: ECHR orders Turkey to release activist immediately
The European Court of Human Rights (ECHR) Grand Chamber has issued a final ruling ordering Turkey to immediately release Osman Kavala, a prominent businessman and human rights activist. The court declared Kavala’s aggravated life sentence, which was upheld in 2023, to be invalid and void under the European Convention on Human Rights.
The Grand Chamber found that Turkey violated several fundamental rights, including the rights to freedom of expression, freedom of assembly and association, the right to a fair trial, and the right to liberty and security. The court also ruled that the detention amounted to inhuman and degrading treatment, noting that the prosecution appeared to have an ulterior motive to silence Kavala for his role in the 2013 Gezi Park protests and his human rights advocacy.
Additionally, the ECHR ordered Turkey to pay Kavala non-pecuniary damages exceeding 110,000 euros. Because this decision was rendered by the Grand Chamber, there are no further avenues for appeal within the ECHR system. The Turkish government has expressed strong opposition to the ruling, characterizing it as a biased approach that exceeds the court's authority.
