ECHR legal proceedings regarding Osman Kavala

Overview

The legal situation surrounding Turkish businessman and activist Osman Kavala has moved toward a final ruling by the Grand Chamber of the European Court of Human Rights (ECHR). Kavala has been detained since October 2017 in connection with the Gezi Park protests.

This case follows a 2019 ECHR decision which found Turkey in violation of several articles of the European Convention on Human Rights, including the right to liberty and security, and ordered Kavala’s immediate release. Turkey’s failure to comply with that mandate led the Council of Europe to initiate infringement proceedings in 2022.

The current proceedings involve a second application filed by Kavala in January 2024. This application alleges further breaches of the Convention, including violations regarding the rights against torture, fair trial, freedom of expression, and freedom of assembly. The Grand Chamber is tasked with evaluating whether subsequent legal proceedings and the finalization of his aggravated life sentence violated these human rights obligations.
