Employment law and the risks of social media activity

Social media activity can lead to professional consequences, including warnings or termination, due to the tension between individual freedom of speech and an employee's duty of loyalty to their employer. While employees have the right to self-determination in their private time under Article 5 of the Basic Law, legal issues arise when online content harms the legitimate interests of a company.

Potential triggers for disciplinary action include posting angry comments about supervisors or colleagues, disclosing internal company information, or accidentally revealing confidential documents in the background of photos. Furthermore, radical political statements or racist and sexist content can prompt employer intervention, particularly if the individual's workplace is identifiable in their profile or if the content has criminal relevance. Courts are often required to weigh the protection of freedom of expression against the employer's business interests.
