Enver Hasani warns of possible nullification of Special Court law
Enver Hasani, the former President of the Constitutional Court in Pristina, has stated there is a possibility that the Constitutional Panel of the Specialist Chambers in The Hague could nullify a new law regarding the Special Court.
The law was passed by the Assembly in Pristina following the conviction of former KLA leaders, who received a combined 81-year prison sentence for war crimes in Kosovo and Metohija. Initiated by the opposition Democratic Party, the amendments narrow the jurisdiction of the Specialist Chambers, reduce maximum sentences, and introduce the possibility of pardons.
Hasani noted that if the Specialist Chambers nullifies the new law, Pristina may have the right to nullify the 2014 Law on the Ratification of the International Agreement, arguing that a state cannot entirely transfer its sovereign will to another mechanism.
