EU packaging regulations impose new compliance burdens on online retailers
New packaging regulations are impacting online retailers across Europe following the implementation of the EU Packaging and Packaging Waste Regulation (PPWR) and the German Packaging Act Implementation Act (VerpackDG) on August 12, 2026.
Under the principle of Extended Producer Responsibility, any commercial entity that first places packaged goods on the German market must register with LUCID and obtain appropriate licenses. Failure to comply can result in fines of up to 200,000 euros. While retailers using standard packaging from German suppliers may receive certain relief, those using custom-branded packaging remain fully responsible for registration and reporting.
The regulations present significant bureaucratic challenges for cross-border trade within the EU. Because the PPWR does not provide a minimum threshold for small quantities, small-scale merchants must navigate individual national EPR systems, registration requirements, and data reporting in every country where they ship. This often necessitates appointing an authorized representative in each destination country, leading to high fixed compliance costs that disproportionately affect small businesses compared to large corporations.
