EU packaging reforms: PPWR, repair rule, Poland debate

Overview

The EU’s Packaging and Packaging Waste Regulation (PPWR) becomes directly applicable on 12 August 2026, replacing the earlier directive and imposing uniform sustainability criteria on all actors in the supply chain. From that date manufacturers, producers, distributors and retailers must map packaging, ensure recyclability targets, label batches or serial numbers, and retain technical documentation for up to ten years (five years for non‑reusable packaging). The Regulation also enforces per‑capita waste‑reduction targets of 5 % by 2030, 10 % by 2035 and 15 % by 2040, bans PFAS in food‑contact packaging, limits empty space in transport packs to 50 %, and requires all packages to be recyclable by 2030 with demonstrable industrial‑scale recycling by 2035. A BPA rule effective 20 July 2026 prohibits intentional use of bisphenol A in food‑contact materials, allowing existing stock to be sold until depleted with transition periods to 2028‑29. EPAL pallets need a Declaration of Conformity from the same August date. In parallel, the EU adopted a Right‑to‑Repair directive that obliges manufacturers and importers to make spare parts available for five to seven years after a product is discontinued, aiming to extend product lifespans and cut waste and CO₂ emissions. Poland is debating a draft Extended Producer Responsibility law that would impose a fee of up to 4.5 zł per kilogram of packaging. The proposal has drawn criticism from the Ministry of Climate and Environment, the Ministry of Finance, the Ministry of Agriculture and the competition authority, who warn it may not be adopted before the 12 August deadline. Industry bodies in the Netherlands seek clarification on “manufacturer” and “producer” definitions, while German groups prepare concrete implementation measures, promoting reusable transport containers and adapting to the expanded German Packaging Act.
