EU member states propose exemptions for controversial packaging rules

EU member states are seeking to exempt European companies from a controversial new requirement to appoint an authorized representative in every country where they sell goods. Since August, the regulation has required sellers to designate a local representative to ensure packaging disposal costs are covered.

Under the proposed compromise, EU-based manufacturers would only be subject to this obligation if they place at least one tonne of packaging on the market in a specific member state per calendar year. This aims to reduce the disproportionate administrative burden on small businesses. Non-EU companies would not receive this exemption.

The European Parliament has also advocated for relief, proposing exemptions for micro and small enterprises with fewer than 50 employees and an annual turnover or balance sheet under 10 million euros. While the EU Commission previously suggested suspending the requirement for EU manufacturers, the Parliament seeks a more permanent solution for smaller entities.

In Germany, no fines will be imposed for violations of these packaging regulations until February 12, 2027, providing companies with a transition period. A final agreement between EU member states and the European Parliament is required for these changes to take effect.
