European Union implements new air passenger rights regulations

The European Union has introduced Regulation (EU) 2026/2202 to strengthen protections for air passengers regarding delays, cancellations, and baggage. The new rules, published in the Official Journal on October 2, 2026, are set to become applicable on October 23, 2027.

Key provisions include a guaranteed right to one free personal item (such as a small backpack or laptop bag) with maximum dimensions of 40 × 30 × 15 cm, provided it fits under the seat. This measure aims to eliminate 'drip pricing' practices. Additionally, the regulation clarifies compensation tiers: 250 euros for flights up to 1,500 km, 400 euros for intra-EU flights over 1,500 km, and 600 euros for longer routes.

A landmark ruling by the Court of Justice of the European Union (Case C-108/26) further bolsters these rights. The Court ruled that airlines can no longer automatically avoid compensation by citing air traffic control (ATC) decisions. Carriers must now prove that such decisions were caused by truly extraordinary circumstances rather than routine operational management. In cases involving both exceptional events and technical faults, judges must distinguish the time caused specifically by the extraordinary event when determining compensation.
