Federal judge blocks Rubio's deportation campaign against student activists

A federal judge in California has ruled that the Trump administration cannot use immigration enforcement to revoke visas or pursue the deportation of lawfully present noncitizens based solely on protected political speech. U.S. District Judge Noël Wise found that the policies pursued by Secretary of State Marco Rubio violated the First and Fifth Amendments.

The ruling stems from efforts to target international students for deportation due to their involvement in campus protests and political activism, specifically regarding pro-Palestinian or anti-Israel demonstrations. The court rejected the administration’s argument that its immigration and foreign policy powers granted broad authority to remove individuals for such activities, determining instead that the government targeted students specifically because of the content of their speech.

The case was brought by The Stanford Daily and a noncitizen student, who argued the policy chilled expression on Middle East-related issues. While the decision does not eliminate the government’s authority to enforce immigration law, it limits the use of visa revocation as a tool to punish constitutionally protected expression.
