U.S. student visa administration and enforcement

The administration of Secretary of State Marco Rubio has faced scrutiny regarding the management and enforcement of student visas. Initially, a group of 30 U.S. senators, led by Independent Senator Angus King, urged the State Department to address significant delays in processing F, M, and J visas. The senators expressed concern that a lack of appointments and staffing could prevent students from arriving for the new academic session, potentially impacting an international student sector that contributes approximately $43 billion annually to the U.S. economy.

Following these administrative challenges, legal conflict emerged regarding the use of immigration enforcement against international students. A federal judge in California ruled that the administration cannot revoke visas or pursue deportation based solely on protected political speech. The court found that efforts to target students involved in campus protests—specifically regarding pro-Palestinian or anti-Israel demonstrations—violated the First and Fifth Amendments, limiting the government’s ability to use visa revocation as a tool to punish constitutionally protected expression.
