US Federal Judge blocks Trump executive orders restricting birthright citizenship
A federal judge in Maryland has issued a preliminary injunction blocking President Donald Trump’s August 6, 2026, executive orders aimed at restricting birthright citizenship. U.S. District Judge Deborah L. Boardman ruled that the orders are likely unconstitutional, noting that the Supreme Court had already upheld the Citizenship Clause of the 14th Amendment in a June 30 ruling.
The executive orders sought to deny automatic citizenship to specific groups, including children of parents deemed ‘alien enemies,’ members of designated terrorist organizations, or those involved in ‘birth tourism.’ The orders also targeted children of certain international workers, such as employees of foreign embassies or international organizations.
Judge Boardman characterized the administration's attempt to implement these restrictions as a way to circumvent the Supreme Court's previous decision. The injunction is limited to children born after February 19, 2025. The White House has criticized the ruling, labeling Judge Boardman an ‘activist judge.’
