Federation of Bosnia and Herzegovina misdemeanor statute of limitations
Receiving a misdemeanor fine a year after the offense occurred does not automatically mean the fine is expired. According to the Misdemeanor Act of the Federation of Bosnia and Herzegovina (FBiH), the statute of limitations depends on the type of offense and whether the competent authority has taken necessary legal actions within the prescribed timeframe.
Under Article 50 of the FBiH Misdemeanor Act, the statute of limitations for offenses with fines up to 3,000 KM is generally two years, while for fines exceeding 3,000 KM, it is three years. Certain specific areas may have a five-year limitation period.
It is essential to distinguish between the statute of limitations for initiating and conducting a misdemeanor procedure and the statute of limitations for the enforcement of a fine that has already become final. For traffic violations, the Law on the Foundations of Road Traffic Safety may also be relevant.
