Bosnia and Herzegovina misdemeanor statute of limitations

Overview

Legal regulations in Bosnia and Herzegovina dictate that traffic and misdemeanor fines do not automatically expire simply because a notice is received long after an incident. The validity of these fines is governed by specific statutes of limitations.

For offenses with fines up to 3,000 KM, a relative statute of limitations of one year applies from the date the police issue and record the notice. An absolute statute of limitations requires the procedure to be concluded within two years of the violation for these amounts, though fines exceeding 3,000 KM may have a three-year limit, and certain tax or environmental violations may extend to five years.

Under the Misdemeanor Act of the Federation of Bosnia and Herzegovina (FBiH), it is necessary to distinguish between the timeframe for initiating a misdemeanor procedure and the enforcement of a fine that has already become final. Any official procedural action taken by authorities can interrupt the statute of limitations, causing the period to restart.
