Fidelity Bank wins appeal against fundamental rights violation ruling

The Court of Appeal in Abuja has ruled in favor of Fidelity Bank, overturning a previous Federal Capital Territory High Court decision. The lower court had originally ordered the bank and the Economic and Financial Crimes Commission (EFCC) to pay N10 million in costs following a fundamental rights violation suit filed by Michael Kundera.

In its judgment, the three-man appellate panel accepted the bank’s argument that its petition to the EFCC was directed at legal entities accused of diverting N100 million in loan funds, rather than at Kundera himself. The court noted that the plaintiff failed to provide credible evidence to prove that his constitutional rights were infringed upon by the bank’s actions.
