However, the Court of Appeal in Abuja overturned this decision. A three-member panel led by Justice Adebukola Banjoko ruled in favor of the bank, accepting arguments that the bank’s petition to the EFCC targeted legal entities accused of diverting ₦100 million in loan funds rather than Kundera himself. The appellate court noted that the plaintiff did not provide sufficient evidence to prove his constitutional rights were infringed upon by the bank’s actions.
