TSE orders Meta to ensure parity for presidential candidates
The Brazilian Superior Electoral Court (TSE) has taken several actions to ensure parity and combat misinformation during the 2026 presidential election. A majority of the court voted to maintain a decision prohibiting Meta from restricting the distribution, recommendation, or search visibility of political content related to the candidates. Failure to comply with this order subjects Meta to a daily fine of R$ 500,000.
The ruling follows allegations from Luiz Inácio Lula da Silva's campaign that Meta's artificial intelligence tools were failing to generate content for him while allowing content for Flávio Bolsonaro. Meta has acknowledged technical failures impacting content distribution and stated it has since improved its AI filters to comply with electoral rules.
Additionally, the TSE has issued specific prohibitions regarding campaign propaganda. Minister Estela Aranha blocked an advertisement from Flávio Bolsonaro's campaign that allegedly used out-of-context clips to link Lula to crimes. Separately, Minister Ricardo Villas Bôas Cueva rejected a request from the Bolsonaro campaign to prevent Lula from recording electoral content at presidential palaces, citing the need to avoid excessive restrictions on political communication.
