FMCSA updates safety data requirements and record retention rules

The Federal Motor Carrier Safety Administration (FMCSA) is implementing updated requirements regarding safety data and electronic record retention. Under rules set for 2026, commercial carriers must maintain electronic duty-status records for a period of six months.

Beyond duty-status logs, various onboard systems provide critical data following commercial truck accidents. These include Engine Control Modules (ECM) for speed and braking data, Electronic Logging Devices (ELD) for driving time and duty status, and telematics or GPS for location and route history. The availability of this information depends on specific equipment, software, and retention settings.

Additionally, the FMCSA has updated its DataQs requirements to improve the review process for inaccurate crash, inspection, and violation data. The new system introduces designated state contacts, a three-stage review process, and defined timelines to ensure reviews are more independent and timely.
