FMCSA safety data and record regulation updates
Overview
The Federal Motor Carrier Safety Administration (FMCSA) has implemented significant reforms to its safety data management and record-keeping requirements for commercial carriers.
A nationwide overhaul of the DataQs system has been completed, establishing a multi-stage independent review process to address disputes regarding roadside enforcement records. This reformed framework introduces strict performance timelines, including 21 days for initial and reconsideration reviews and 45 days for final decisions, aimed at reducing administrative backlogs and improving data integrity.
In conjunction with these reforms, the FMCSA is updating requirements for electronic record retention. Commercial carriers are now required to maintain electronic duty-status records for six months. The agency also highlighted the importance of data from onboard systems, such as Engine Control Modules (ECM), Electronic Logging Devices (ELD), and telematics, which provide critical information following commercial truck accidents.
