Argentina Chamber of Deputies resumes Malvinas Sovereignty Law debate

The Argentine Chamber of Deputies has resumed debates on the National Sovereignty Defense bill, also known as the Malvinas Law. The project seeks to significantly increase penalties for the unauthorized exploitation of natural resources, including fishing, mining, and hydrocarbons, in the Malvinas Islands and surrounding maritime spaces. Proposed sanctions include prison sentences of up to 20 years and bans on commercial operations within the country.

The legislative debate occurs amid intense political tension following a Supreme Court ruling that overturned the suspension of land sales to foreign entities. In response, the La Libertad Avanza (LLA) bloc is considering adding a chapter to the Private Property Inviolability project to restrict foreign land ownership. Simultaneously, a provincial senator in Buenos Aires has proposed a local law to limit foreign rural land ownership to 15%.

Additionally, the judiciary has ordered the national government to preserve and report all information regarding rural lands in Buenos Aires province that was collected prior to the repeal of the Land Law via DNU 70/2023. The government has rejected opposition requests to split the Malvinas bill and is considering the creation of a bicameral oversight commission to monitor the implementation of the law.
