France bans telemarketing calls without prior consent from August 2026
Starting 11 August 2026, French law will prohibit commercial telephone solicitations unless the consumer has given explicit prior consent. The new regime replaces the opt‑out system based on the Bloctel list, which will be discontinued on that date.
The consent must be free, specific, informed, unambiguous and revocable, and may remain valid for no more than one year. Companies must present a clear request that identifies the caller, the nature of the offer and the consent period. Consumers can withdraw consent at any time, even orally. Exceptions are limited to calls relating to an existing contract or to customers who have provided the required consent.
Violations expose firms to administrative fines of up to €75,000 for individuals and €375,000 for legal entities, and any contract concluded after a non‑compliant call will be declared void. Oversight is shared by the DGCCRF, CNIL and ARCEP. The implementing decree (n° 2026‑662) was published in the Journal officiel on 25 July 2026, enacting article 13 of law n° 2025‑594 of 30 June 2025, which amends article L223‑1 of the Consumer Code.
