France legalizes assisted dying and euthanasia
France has officially implemented a new law regarding assisted dying and euthanasia, following its publication in the Journal Officiel on August 19, 2026. The legislation, which was approved by the National Assembly and validated by the Constitutional Council, allows certain adults to access medical assistance to end their lives.
To qualify, patients must be French nationals or long-term residents suffering from a serious, incurable, and life-threatening condition in an advanced or terminal stage. The law requires that the individual's suffering—whether physical or psychological—be unbearable and that they maintain the capacity to make a free and informed decision. While patients can typically administer the lethal substance themselves, medical professionals may do so if the patient is physically unable.
A significant and controversial provision of the law mandates that life insurance companies must pay out policies in cases of assisted dying. This rule applies to existing policies as well, preventing insurers from using standard suicide exclusion clauses. While supporters argue this ensures patients' decisions have no financial penalty for their beneficiaries, critics have raised concerns regarding potential economic incentives for assisted death.
