Assisted‑dying debate: Spain, France, Italy, NL
Overview
The public discussion of assisted dying continues to evolve across Europe. In Spain, a TikTok appeal after Noela Castillo’s death revived debate over the 2021 law; a Supreme Court ruling in May gave families limited appeal rights. By June 2024, five‑year data show about 3,700 applications and 1,700 deaths, with higher use in the Basque Country and Catalonia. In July 2026 the Health Ministry approved a second edition of the Manual of Good Practices in Euthanasia, adding organ‑donation provisions, formalising nurses’ role and extending the postponement period to six months. France is poised to pass its right‑to‑die bill on 15 July 2026, concluding a multi‑year parliamentary battle. The National Assembly will adopt a law that creates a right to assisted suicide and, in limited cases, euthanasia, making France one of the few countries permitting medically assisted death. The draft sets five eligibility conditions – adult French citizen or resident, serious incurable illness in a terminal or advanced stage, refractory suffering, and a free, informed wish to die – and requires a physician to decide within 15 days, followed by a mandatory two‑day reflection period. If the patient cannot self‑administer the lethal drug, a caregiver may do so; all steps are reimbursed by health insurance. A conscience‑clause obliges dissenting professionals to refer the patient to another willing colleague. The bill, championed by President Emmanuel Macron and drafted by Health Minister Agnès Firmin Le Bodo, will be referred by Prime Minister‑designated minister Sébastien Lecornu to the Constitutional Council to test compatibility with human dignity, personal freedom and protection of vulnerable adults. Opposition from right‑wing deputies, religious groups and the Catholic bishop of Lille (Marc Aillet) warns that legislators voting for the law could be barred from Holy Communion.
