France: Emmanuel Macron promulgates assisted dying law
President Emmanuel Macron has officially promulgated the law establishing the right to assisted dying in France. Following its publication in the Official Journal on August 19, the legislation marks the conclusion of years of intense national debate.
The law permits certain patients to access a lethal substance to end their lives. To be eligible, patients must be adults, French nationals or long-term residents, and suffering from a serious, incurable illness in a terminal or advanced stage. They must also experience unbearable physical pain and maintain the capacity to make an informed decision until the end. While patients are encouraged to self-administer the substance in the presence of a healthcare professional, medical staff may intervene if the patient is physically unable to do so.
The Constitutional Council recently validated the text, though with certain reservations regarding the conscientious objection clause for medical staff and protections for patients under guardianship. The law specifies that psychological suffering alone is not sufficient grounds for the procedure. Implementation of the law awaits the publication of necessary government decrees to establish specific application procedures and monitoring mechanisms.
