German court upholds ban on traffic point trading

The German Federal Constitutional Court has rejected a constitutional complaint against regulations in the Road Traffic Act that prohibit the transfer of penalty points to other individuals.

This ban, which aims to prevent traffic offenders from avoiding punishment by using proxies or commercial agencies to take responsibility for their violations, remains in effect. The court stated that the complaint failed to sufficiently demonstrate how the law violates fundamental rights or why potential fines of up to 30,000 euros are disproportionate.

The regulation seeks to curb the practice of false self-incrimination or the use of 'straw men' to manage points in the Flensburg register. According to a 2025 ADAC survey, 43 percent of drivers with entries in the register were aware of commercial point trading.
