German traffic law regulation on penalty point transfers

Overview

New German legislation implemented on July 1, 2026, officially closed a legal loophole that allowed individuals to transfer traffic penalty points and driving bans to others. Under the updated Road Traffic Act, deceiving authorities regarding the identity of a person involved in a violation is prohibited. Both the act of deception and the mediation of such services by commercial “points traders” are now classified as administrative offenses, carrying potential fines of up to 30,000 euros.

Following the implementation of these rules, the German Federal Constitutional Court upheld the ban after a constitutional complaint was filed. The court rejected the challenge, stating that the complainant failed to prove the law violated fundamental rights or that the fines were disproportionate. The regulation aims to prevent the use of proxies or ‘straw men’ to manage entries in the Flensburg register, a practice that a 2025 ADAC survey indicated was known to 43 percent of drivers with register entries.
