German Defence Minister Pistorius Faces Lawsuit Over Cancelled F126 Frigate Project

In July 2026 the Dutch Damen shipyard announced it will pursue legal action and seek up to €2.3 billion in damages after German Defence Minister Boris Pistorius cancelled the €15 billion contract for six F126 frigates. The shipyard, represented by lawyer Peter Gauweiler, described the cancellation as an "overstürzte und willkürliche politische Entscheidung" – a rushed and arbitrary political decision made without legal justification. It claims the Bundeswehr procurement office had not issued any warning, deadline or formal notice before terminating the contract.

Pistorius rejected the allegation of legal breach, saying the decision was taken to prevent further loss for taxpayers and that the cancellation was carefully considered. The dispute follows a series of delays and cost overruns that began after the original 2020 order, which was expanded in 2024, and a failed attempt by Rheinmetall to act as general contractor in late 2025. Legal letters have been sent to the procurement office, the minister and the Bundestag’s budget committee, signalling a protracted legal battle over the aborted frigate programme.
