Germany housing rights: Tenant protections and rental crisis
Legal experts and tenant associations in Germany are clarifying the rights of renters regarding property access and the broader implications of the ongoing housing crisis.
According to legal representatives from Haus & Grund Deutschland and the DMB Mieterschutzverein, landlords do not have a general right to enter a property without a specific reason. Valid reasons include repairing defects, reading meters, or showing the unit to prospective tenants after a notice of termination. While tenants must generally allow access for planned maintenance or inspections by craftsmen, landlords must provide timely notice, with two weeks being considered appropriate for non-urgent matters.
Separately, the Deutscher Mieterbund (DMB) has issued its 2026 Mietenreport, warning that the housing crisis is evolving into a social crisis. A Forsa survey indicates that 50 percent of German tenants fear they will not find affordable replacement housing, and 29 percent worry about being unable to pay future rent. The DMB is calling for a nationwide rent freeze and stronger enforcement of rent control measures to protect both low-income and middle-class households.
