Germany approves strict liability rules for e-scooter rental companies
The German Bundesrat has approved a legislative change that extends strict liability rules to e-scooters, aligning them with the regulations for cars and motorcycles. This reform follows a significant increase in accidents involving electric micro-mobility devices, which rose from 5,860 in 2020 to 12,509 in 2024.
Under the new rules, rental companies such as Lime, Bolt, and Tier will face strict liability (Gefährdungshaftung) as owners. This means they can be held liable for damages regardless of fault, providing accident victims with a more direct path to compensation. Additionally, riders will face a presumption of fault, meaning they must prove they were not responsible for an accident to avoid liability.
The law is expected to take effect on the first day of the quarter following its official announcement, likely starting January 1, 2027. While the measure aims to increase protection for accident victims, it is anticipated that rental companies may pass on the increased costs to consumers through higher rental fees.
