Germany criminalizes traffic “points trading”

As of July 1, 2026, the practice of “points trading” in Germany has become a criminal offense. This legal change targets individuals and commercial agencies that attempt to evade traffic penalties by having third parties officially accept responsibility for speeding or red-light violations.

Previously, a loophole allowed drivers to avoid points in the Flensburg driving register by using “straw men.” These individuals would fill out hearing forms claiming to be the driver at the time of the offense. Because self-incrimination for an administrative offense was not illegal, and blurry speed camera photos made identification difficult, the practice flourished through organized internet agencies. Under the new regulations, such actions can result in fines of up to 30,000 euros.
