German traffic and parking regulations

Overview

German traffic regulations govern parking enforcement, the national penalty point system, and driving requirements. Specific zones for car-sharing services are identified by sign 1010-70; unauthorized parking can result in 55-euro fines or towing costs exceeding 200 euros. The penalty point system, managed by the KBA, assigns points based on offense severity: one point for mobile phone use, two for running red lights, and three for serious violations like driving under the influence. Accumulating eight points leads to license revocation. Points expire after 2.5 to 10 years. Driving licenses include mandatory codes in Field 12 for corrective eyewear, such as code 01 for glasses or 01.02 for contact lenses. Violating these conditions or using mobile devices while driving can lead to fines and points. Regarding mobile phone use, interacting with a smartphone—including checking the time—can trigger fines starting at 100 euros. Some regions are currently testing Monocam systems to automatically detect these violations via camera and software. Legal distinctions exist between parking types. While disabled spaces are strictly regulated, mother-child spaces are not governed by the Road Traffic Regulations (StVO). Additionally, pedestrians attempting to reserve parking spaces may face fines of 10 to 20 euros. Motor scooters are subject to the same parking requirements as cars; parking on sidewalks is generally prohibited unless explicitly permitted, with fines starting at 55 euros and increasing to 70 euros plus a penalty point if pedestrians are obstructed. Regarding parking machines, motorists are expected to find a functioning machine within a reasonable distance (approximately 150 meters) rather than automatically using a parking disc if a meter is broken. A significant legal shift occurred on July 1, 2026, when “points trading”—the practice of paying others to take responsibility for violations to avoid license loss—was criminalized, carrying potential fines of up to 30,000 euros.
