Germany updates disability documentation and legal rights
In Germany, several regulatory and administrative changes affect individuals with disabilities. Starting in 2026, the process for claiming the disability tax allowance (Behinderten-Pauschbetrag) has shifted from paper-based documentation to electronic data transmission between authorities. While the physical disability ID card remains valid for daily benefits like public transport discounts, tax-related proof is now handled digitally.
Regarding employment, individuals are not legally required to disclose their degree of disability (GdB) during job applications unless the disability is obvious or specific workplace accommodations are necessary. However, applicants for public service positions are encouraged to disclose their status to benefit from legal protections that mandate interviews for qualified disabled candidates.
Legal precedents also clarify that a disability ID marked as “unlimited” does not guarantee permanent status. The Federal Social Court has ruled that the degree of disability is a continuous administrative act that can be reviewed and adjusted if a person's health improves significantly. Furthermore, under the Federal Participation Act, individuals with a GdB of 50 or higher must manage their own bank accounts to receive benefits like pensions or housing allowance directly.
