Germany employment law disputes rise amid economic instability

Employment-related legal disputes are increasing in Germany due to a weakening economic climate. According to data from the German Insurance Association (GDV), employment law disputes accounted for 15.3 percent of all reported legal protection insurance claims in the second quarter of 2026, up from 14.6 percent in the previous year and 14.2 percent in 2024.

The trend is even more pronounced regarding insurance payouts. Between January and June 2026, employment law protection represented 38.6 percent of all legal protection insurance payments, compared to 36.8 percent in 2025 and 33.9 percent in 2024. GDV Managing Director Jörg Asmussen noted that conflicts regarding job cuts and restructuring increase as companies reorganize, often impacting the economic existence of employees.

The rise in legal disputes coincides with broader economic instability in Germany. The Federal Statistical Office reported 12,812 corporate insolvencies in the first half of 2026, a 6.7 percent increase over the same period the previous year. Additionally, unemployment figures reached over three million people in August, an increase of 36,000 compared to the prior year.
