Germany increases debt protection limits for pensioners

New regulations regarding attachment limits (Pfändungsfreigrenzen) in Germany have come into effect as of July 1, providing increased protection for debtors, including pensioners. Under these rules, which remain in place until June 30, 2027, a pensioner with no legal maintenance obligations is entitled to a fully protected net monthly amount of up to 1,589.99 euros.

For those with dependents, the protected threshold increases. For example, supporting one person (such as a spouse) raises the threshold to approximately 2,187 euros, with additional increments of 332.83 euros for each subsequent dependent up to five people. If a net pension exceeds these limits, creditors cannot seize the entire surplus; seizures are governed by a graduated official table to ensure funds remain for basic living costs.

The level of protection depends on the method of seizure. Direct seizures through the German Pension Insurance (Deutsche Rentenversicherung) ensure the protected portion is paid to the individual while only the seizable portion is redirected to the creditor. However, in the case of bank account seizures (Kontopfändung), banks do not automatically protect pension funds, which can lead to total account freezes and the interruption of standing orders for rent and utilities.
