Germany did not meet the EU‑mandated deadline of 7 June 2026 to transpose Directive 2023/970, which aims to strengthen equal pay for men and women through pay‑transparency mechanisms and enforcement tools. The missed deadline could trigger an EU infringement procedure, allowing the European Commission to refer the case to the Court of Justice and potentially impose financial penalties.

German courts are already expected to interpret existing national pay‑transparency rules in line with the undelivered EU measure, and recent rulings of the Federal Labour Court have tightened the standards for justifying gender‑based wage differences. Business leaders, such as Patrick Löffler of the digital benefits firm givve, argue that companies should start explaining salaries internally now rather than waiting for legislation, noting that “Clear is kind”.

If the directive remains unimplemented, employees may still invoke its provisions in national courts under the principle of direct effect, while employers risk increased scrutiny and legal challenges over discriminatory pay practices.
