Germany: Court rulings address pension and social security complexities

Recent German court rulings have highlighted complexities in pension and social security law. The Landessozialgericht Berlin-Brandenburg ruled that the German Pension Insurance cannot reclaim funds previously paid to a Jobcenter due to a change in legal assessment. In this case, the pension insurance had already fulfilled reimbursement claims for a recipient's disability pension, and a subsequent change in legal interpretation did not create a new obligation for the recipient to repay the €21,140.62.

In a separate matter, the Landgericht Karlsruhe addressed the impact of partial pensions on supplementary benefits. A retiree who opted for a partial pension of 99.99% of his statutory old-age pension lost his monthly supplementary pension of €843.60 for six months. The court noted that the statutes of the supplementary pension fund required a full statutory pension to trigger benefits, resulting in a total loss of over €5,000 for the individual.
