German pension reform and survivor benefit updates

The German Pension Commission has proposed reforms to the national pension system, including replacing the current survivor's pension with a mandatory pension splitting model. Under this proposal, pension points earned during a marriage would be equally distributed between partners.

As of September 2026, current regulations for the approximately 5.7 million widows and widowers receiving statutory benefits remain in place. Eligibility for the ‘large’ widow's pension, which provides 55 to 60 percent of the deceased partner's pension, often depends on age, disability, or raising children. To qualify, a marriage or registered partnership must generally have lasted at least one year, and the deceased must have met a five-year contribution period.

Changes to pension calculations effective July 2026 may impact those receiving both a disability pension and a survivor's pension. Certain supplements for older disability pensions will now be factored into income calculations, potentially reducing survivor's pensions if total income exceeds specific tax-free allowances. These allowances are scheduled to increase to mitigate the impact.

Recent court rulings have further addressed complexities in social security law. The Landessozialgericht Berlin-Brandenburg ruled that German Pension Insurance cannot reclaim funds previously paid to a Jobcenter due to changes in legal interpretation regarding retroactive disability pension benefits. In a separate case, the Landgericht Karlsruhe addressed the impact of partial pensions on supplementary benefits. The court noted that a retiree who opted for a partial pension of 99.99% of his statutory old-age pension lost a monthly supplementary pension of €843.60 for six months, as the fund's statutes required a full statutory pension to trigger such benefits.
