German states threaten legal action over rising rail track fees
Transport ministers of several German states announced they will sue the federal government if the newly increased rail track fees are not compensated. The European Court of Justice ruled in March that the previous price‑cap for regional passenger rail was incompatible with EU law, prompting the Federal Network Agency to raise the fees. The new rates are expected to generate additional costs of roughly €800 million for 2025‑2026, which the states say will financially cripple regional rail services.
State ministers warned that the current system “breaks the regional rail financially” and threatened to take the matter to court unless the federal government provides full financial compensation. Federal Transport Minister Steffen Bilger has been urged to open negotiations promptly. The dispute risks higher ticket prices and possible service cuts if unresolved.
