Ho Chi Minh City resident disputes land classification for inheritance

A resident in Ho Chi Minh City is facing legal difficulties regarding the inheritance and registration of land that was officially classified as perennial crop land (LNK) despite being used as residential land since 1980. The family has paid residential taxes since 1992 and received documentation in 2006 identifying the plot as urban residential land. However, the Ho Chi Minh City Land Registration Office (Branch 7) has refused to process the inheritance and change of registration documents.

The authorities have requested that the family provide an administrative penalty decision regarding land violations. The resident has contested this requirement, noting that local ward records show no history of construction violations. The Ministry of Natural Resources and Environment stated that because this is a specific case, it must be resolved based on local archives and specific regional regulations, as they lack sufficient information to provide a definitive ruling on the individual matter.
