United States imposes sanctions against International Criminal Court
On October 9, 2026, the United States announced sanctions against the International Criminal Court (ICC) under Executive Order 14203. The measures aim to restrict transactions and services involving the institution, following tensions regarding the Court’s investigations into American-aligned interests. The order prohibits US persons from providing material support or financial services to designated entities and exposes non-US persons to the risk of secondary sanctions.
The sanctions have raised significant concerns regarding the ICC’s operational capacity, particularly its reliance on US-connected financial and information technology systems. Experts warn that banks and service providers outside the US may cease working with the Court to avoid US Treasury penalties, potentially disrupting the Court’s ability to maintain accounts, pay staff, and receive member state contributions. The order includes a six-month wind-down period.
In response, the European Union is considering activating its Blocking Statute to protect the ICC and European companies from the impact of these extraterritorial measures. EU officials and human rights organizations, including Amnesty International, have expressed alarm, noting that such actions could undermine global justice and the independence of international courts.
