Overview

The United States has escalated its campaign against the International Criminal Court (ICC), moving from targeting specific individuals to imposing sweeping institutional sanctions. The Trump administration characterized the ICC as a “threat to U.S. sovereignty” and a “rogue court” following arrest warrants issued for Israeli Prime Minister Benjamin Netanyahu, former defense minister Yoav Gallant, and former Hamas commander Mohammed Deif. In response, the ICC is transitioning to European IT systems and open-source solutions like OpenDesk to mitigate vulnerabilities. Reports indicate technical interference, including allegations that Microsoft closed the account of the ICC’s chief prosecutor.

International opposition has intensified. Japanese Prime Minister Sanae Takaichi expressed regret, stating the sanctions are incompatible with Japan’s support for the rule of law. The European Union is considering activating its Blocking Statute to protect the ICC and European companies. In The Hague, Mayor Jan van Zanen described the sanctions as “unwise,” warning they could disconnect the court from global financial systems, and suggested the potential necessity of an independent bank. Deputy prosecutor Nazhat Shameem Khan reported that staff are already facing banking difficulties as institutions “over comply” to avoid risk.
