Hungary inheritance laws regarding estate assets and unclaimed funds

In Hungary, certain funds can be accessed without waiting for the conclusion of formal probate proceedings. If a deceased individual designated a death beneficiary for their bank account, those funds do not enter the estate. The beneficiary, who does not need to be a relative, can request payment upon providing proof of death and required documentation.

Additionally, unclaimed pensions can be requested by specific relatives—such as a spouse living in the same household, children, grandchildren, parents, grandparents, or siblings—without waiting for a notary. Such requests must be made within one year of the death. If no household members are available, heirs may claim the funds after obtaining a legally binding inheritance decree, provided they apply within one year of the document's effectiveness.

When no will exists and no legal heirs can be found or they all renounce the inheritance, assets and debts pass to the state or local municipalities. The Magyar Nemzeti Vagyonkezelő Zrt. acts on behalf of the state in these cases. Since July 1, 2023, local municipalities inherit domestic real estate and its contents, while the state retains ownership of other assets such as bank accounts, vehicles, and companies.
