ICC prosecutors seek to admit witness testimony in Duterte case
Prosecutors at the International Criminal Court (ICC) have requested that Trial Chamber III admit the previously recorded testimony of a key witness, identified as P-1100, in the case against former Philippine President Rodrigo Duterte.
The prosecution filed the application under Rule 68(3), describing the testimony as “relevant, reliable, and probative.” The evidence reportedly concerns the alleged policy to “neutralise” through violent crimes, including murder, suspected criminals in the Philippines. Furthermore, the testimony is expected to provide insight into the modus operandi of the Davao Death Squad (DDS) and Duterte’s alleged individual criminal responsibility, specifically regarding his knowledge and intent.
Acting Prosecutor Mame Mandiaye Niang noted that using the recorded statements could reduce the direct examination of the witness from approximately seven hours to two hours. This measure is intended to save court time and account for Duterte’s health condition. The prosecution emphasized that admitting the prior testimony would not prejudice the defense, as P-1100 remains available for cross-examination by all parties. Duterte is currently facing charges of crimes against humanity related to killings during his tenure as Davao City mayor and as President.
