Idaho abortion legal battles continue as court orders and ballot language are finalized

Legal developments regarding abortion access in Idaho have intensified following two significant court actions. A panel of the Ninth Circuit Court of Appeals has placed a hold on a federal order that would have provided broader protections for doctors performing abortions under specific health-related circumstances. This stay effectively maintains Idaho’s strict abortion ban, which only permits the procedure to prevent the death of the pregnant woman or in documented cases of rape or incest during the first trimester. The Ninth Circuit is scheduled to hear arguments on the matter on September 22.

Separately, the Idaho Supreme Court has approved the final ballot language for Proposition One, an abortion initiative set for the November election. In a 4-1 ruling, the court accepted revised “Yes/No” statements submitted by Attorney General Raúl Labrador and Secretary of State Phil McGrane. A “Yes” vote would support creating a right to abortion before fetal viability and in medical emergencies, while a “No” vote would maintain current state laws. The court's decision overruled objections from advocates who argued the language did not sufficiently highlight the criminal penalties doctors face under existing statutes.
