Following a federal district court ruling that invalidated portions of Idaho’s near-total abortion ban, Idaho Attorney General Raúl Labrador has filed an appeal and an emergency motion with the Ninth Circuit Court of Appeals.
The legal challenge stems from Judge Lynn Winmill’s decision in a lawsuit brought by Boise physician Stacy Seyb. Judge Winmill ruled that the Fourteenth Amendment provides a ‘narrow but fundamental right to abortion when a pregnancy threatens the woman’s life or health.’ This ruling specifically addressed the state’s failure to include sufficient health-based exceptions, including those for mental health crises that increase risks of self-harm or suicide. The court declined to block bans in cases where a fetus has a life-threatening condition unless that condition also poses a serious threat to the pregnant person’s health.
Labrador is contesting the decision, arguing that the judge ‘legislated from the bench and manufactured a new constitutional right to abortion’ and that the standard is overly broad.
In a recent development, a Ninth Circuit Court of Appeals panel placed a hold on the federal order that would have provided these broader health-related protections, effectively maintaining Idaho’s strict ban pending arguments scheduled for September 22.
Simultaneously, the Idaho Supreme Court approved the final ballot language for Proposition 1, the ‘Reproductive Freedom and Privacy Act Initiative,’ for the November election. In a 4-1 ruling, the court accepted revised language that would support creating a right to abortion before fetal viability and in medical emergencies if passed, while a ‘No’ vote would maintain current state laws.
